U.S. Senator Adam Schiff reintroduced legislation, originally proposed in 2021, to strengthen guardrails against presidential overreach. The Protecting Our Democracy Act, as it is called, seeks to restore the balance of power between Congress and the Executive Branch and safeguard democratic institutions. CERL’s Professor Claire Finkelstein and Professor Richard Painter offer their take on the bill in a 2021 piece at Lawfare, urging Congress to make clear that no one, not even a sitting president, is above the law.
