The Conference
The University of Pennsylvania’s Center for Ethics and the Rule of Law (CERL) will convene a two-day conference on ethical and legal aspects of battlefield AI and Robotics. Proceedings will take place at the University of Pennsylvania in Philadelphia on October 8-9, 2026 and will be co-sponsored by Perry World House and Penn Global.
The conference will focus on developing ethical and legal frameworks for using weaponized Artificial Intelligence (AI), Autonomous Weapons Systems (AWS), and robotics on the battlefield. This gathering is part of a forthcoming volume on battlefield AI and robotics in the Oxford University Press (OUP) Series in Ethics, National Security, and the Rule of Law. That research will give volume participants an opportunity to share their draft papers with each other as well as with a cadre of experts. In addition to shared discussion around the draft papers for the volume, conference sessions will cover a broad range of additional topics reflecting current developments in battlefield AI and robotics and the operational, ethical, and legal frameworks that surround them.
The event will convene in the morning of October 8 and end mid-day on October 9, during which time there will be a public keynote session in which leading academic researchers and policy practitioners will examine the opportunities and challenges posed by these advanced battlefield technologies, as well as five closed-door workshop sessions. Cutting-edge papers written by academics, scientists, engineers, military leaders, and legal practitioners will serve as the background reading for the closed-door session discussions.
The OUP Series in Ethics, National Security and the Rule of Law is a collection of interdisciplinary books designed to address abiding questions at the intersection of national security, moral and political philosophy, and practical ethics. It seeks to illuminate both ethical and legal dilemmas that arise in democratic nations as they grapple with today’s highly complex security challenges. The Series is designed to reflect interdisciplinary engagement between academic researchers and policy practitioners, with the aim of promoting the rule of law in the context of contemporary armed conflict and national security practices. The current conference will contribute to this endeavor.
CERL is a non-partisan interdisciplinary institute at the University of Pennsylvania dedicated to preserving and promoting the rule of law in national security, warfare, and democratic governance. Military and intelligence personnel, lawyers and other private sector professionals, and academics in the disciplines of law, national security, ethics, philosophy, political science, and international relations converge at CERL conferences and symposia to engage in robust discussion and analysis and to provide normative guidance to policymakers, public officials, the private sector, the press, and members of the public. CERL specializes in the ethical and constitutional dimensions of national security policies and practices, as well as their adherence to the rule of law.
Conference Overview
Decades of research, discussion, and debate are coming to fruition as advanced AI-based battlefield technologies enter the deployment phase in armed conflicts across the globe. Conflicts in Ukraine, Israel, and Iran show how much AI, drones, and robots have remade the modern battlefield. Despite popular dread and growing concern regarding the introduction of AI-based intelligence analysis and Lethal Autonomous Weapons (LAWS) into the battlefield, countries around the world increasingly grapple with the ethics and legality of weaponized AI-enhanced targeting operations in armed conflict. Both domestic policy efforts and international negotiations reflect the complexity of the likely impending transition to routine battlefield applications of AI and AWS.
The use of advanced AI-based technologies is at an inflection point, at which ethical, legal and policy questions abound. What ethical constraints should guide the use of autonomous weaponry and artificial intelligence in warfare? Are such technologies compatible with a rigorous commitment to maintaining appropriate levels of human judgment in autonomous and semi-autonomous technologies when introduced into warfighting? Is the use of such technologies on the battlefield compatible with a robust defense of International Humanitarian Law (IHL) and the Law of Armed Conflict (LOAC)? Will such technologies impair attributions of responsibility to humans in the chain of command, or do they compromise fundamental principles of command authority? Does the deployment of AI-enabled target selections and LAWS threaten to unleash an arms race of massive proportions? If so, can the accelerated development and deployment of such weaponry be contained? Or have the operational, economic, and diplomatic pressures to deploy AWS and other advanced technologies reached a tipping point that makes restrictions impossible or fruitless?
A related set of questions concerns the use of LLMs in military operations, and in particular their role in Artificial Intelligence-Based Decision Support System (AI-DSS). This includes intelligence processing and target selection in targeted killing operations. LLMs are regarded as indispensable to direct action campaigns, particularly in counterinsurgency operations, given the speed and pacing of contemporary warfare. By the same token, civilians face significant added risks from the accelerated AI-DSS targeting pace enabled by LLMs. This acceleration, in turn, drives the perception that modern conflict cannot be fought without the assistance of LLM’s because human judgment simply cannot keep pace with the volume and speed at which targeting intelligence must be processed. But the long-standing commitment to engage reasonable levels of human judgment at all stages of the kill chain under U.S. and European guidance may suggest that AI-DSS should be more sharply limited. Failure to limit reliance on AI-DSS has sometimes proven catastrophic, but human judgment has, on occasion, too. Because technology is often believed to be more accurate than humans, military operators tend to rely heavily on AI-generated data about appropriate targets. But is this reliance ethical, lawful, or even operationally valuable?
Since AI-DSS are currently already in extensive use on the battlefield, both by the U.S. and by other countries as well as nonstate actor groups, they are likely a permanent feature of modern warfighting. A further step has not, by and large, been taken and will likely determine the future: tying the use of AI-DSS directly to physical autonomous weapons technologies and allowing widely distributed (“edge”) corporeal systems to target and engage based on entirely automated target identification. Such combined technologies would leave little room for human judgment and have the potential to vastly magnify information acquisition and processing errors, semantic misalignment, and targeting missteps that have resulted in the deaths of thousands of civilians. We are poised on the brink of such an evolution with little perceived bandwidth for reflection. Yet policymakers, lawyers, defense industry professionals, combatant commanders, engineers, and others implicated in the chain of direct-action determinations must seize this moment to reflect on the direction technological developments are taking us.

The conference will include one public session and five non-public sessions. The closed-door sessions build on an earlier gathering on related themes CERL held in Spring 2024. The previous conference, entitled “Ethical and Legal Dilemmas of Autonomous Weapons in War and National Security,” brought together experts from across a broad swathe of professions and expertise: engineers, lawyers, philosophers, cognitive scientists, ethicists, and related professionals in the defense industry. That 2024 conference aimed to explore durable ethical, legal and policy guidelines for the development and potential use of AWS. The 2026 conference will update these discussions with an exploration of the most recent battlefield technologies and the impact they have had on the tempo and lethality of large scale combat operations.

Session 1
Unpacking the Targeting Decision
Integrating artificial intelligence into the kill chain represents one of the most significant evolutions in modern warfare. New normative questions are emerging about targeting, including compliance with international humanitarian law, unexamined ethical dimensions, and changes to domestic regulations. The U.S. Department of Defense has seemingly revised its battlefield targeting doctrine to allow artificial intelligence to initiate actions with human oversight, marking a significant shift in how the U.S. military approaches AI-enabled military targeting.
The new reportedly revised DoD targeting principles envision “systems where AI initiates actions with human monitoring.” This differs from “human in the loop” systems, where a human initiates each action. This policy shift is part of a broader push toward autonomous systems, driven by the speed of future warfare and advances in adversary AI.
DoD Directive 3000.09 on Autonomy in Weapons Systems was last revised three years ago. President Donald Trump signed National Security Presidential Memorandum 11, titled “Artificial Intelligence in the National Security Enterprise,” on June 5, 2026. The directive mandates the U.S. military and intelligence community to accelerate AI adoption, reversing multiple Biden-era oversight requirements. NSPM-11 requires the Pentagon to update 3000.09 — within 90 days — and institute annual reviews “to account for the rapidly evolving capabilities of AI systems.” The session will examine these policy developments and their potential impact.
The intersection of these policies governing battlefield AI and technological developments compels a rethinking of empirical and normative components of a targeting decision. Empirical decisions driven by measurable data, technological capabilities, and tactical optimization are part of the equation. But so do normative elements. Key areas to examine during this session include how ethical and legal constraints shape targeting decisions, and how humans have made those decisions in the past. Does our growing dependence on AI for the empirical processing speed preclude human decision-making in the normative realm?

Session 2
How are Large Language Models changing the pace and nature of modern warfare?
The emergence of Large Language Models (LLMs) has revolutionized digital transformation, positioning Artificial Intelligence (AI) at its core. LLMs’ exceptional capabilities have enabled diverse applications across industries. However, the ethical and legal examination of AI’s role on the battlefield has not kept pace with evolving battlefield norms.
This session examines the transformative potential of LLMs in modern warfare and evaluates their applicability in military contexts. It delves into the technical aspects of LLMs, emphasizing their capability to autonomously generate contextually relevant text using deep learning principles. It also discusses potential military applications, such as enhancing decision-making and improving battlefield functions, including intelligence, surveillance, target acquisition, and reconnaissance (ISTAR) integration.
The potential use of LLMs to assist humans and enhance military processes holds great promise and could offer significant advantages for achieving operational and even strategic objectives. However, bias in training data, accountability for model outputs, and potential hallucinations highlight the importance of maintaining human oversight and responsibility in decision-making. As operations speed up and intensify, it remains unclear whether human operators can stay in control. When mistakes happen, the public is willing to blame LLMs, but whether that is warranted remains an open question. Analyzing incidents, such as the bombing of the Shajareh Tayyebeh girls’ elementary school in Minab, Iran, is key to determining lessons learned whenever tragedy results from LLMs, human error, or both.

Session 3
Artificial Intelligence, Autonomous Weapons Systems, and Civilian Harm Mitigation
In 2025, a CERL report stressed the importance of DoD programs to mitigate civilian harm amid efforts to slash it. As a report from the Center for Naval Analysis highlights, countries worldwide have taken early steps to leverage artificial intelligence (AI) in military capabilities and to prevent and mitigate civilian harm. A main concern is whether military AI can distinguish between valid military targets and civilians.
This session will consider how AI in warfare can strengthen policies to protect civilians and mitigate civilian harm. In 2016, the NATO Policy for the Protection of Civilians (2016) set out that all feasible measures must be taken to avoid, minimize, and mitigate harm to civilians. In 2022, the U.S. Department of Defense introduced the Civilian Harm Mitigation Action Response Plan (CHMR-AP). Yet many questions remain as experts consider how to implement this framework amid the emergence of battlefield AI. The session examines whether AI systems provide the capabilities combat commanders need to mitigate civilian harm successfully.

AI Lethality: Ethical and Legal Limits of AI-Enhanced Target Selection in Battlefield AI.
This public keynote panel will address the ethical and legal dilemmas of autonomous weapons and artificial intelligence (AI) with special focus on AI-enhanced targeting. It will examine key questions: What are the promises and perils of emerging technology on the battlefield? How can the United States and other actors ensure AI is used responsibly and in compliance with existing normative and legal frameworks? What kinds of ethical principles should guide the development and deployment of AI and autonomous weaponry? What are the socio-political forces that force governments to examine the inherent tension within emerging technologies and moral and legal choices?

Session 4
Moral Reasoning and Expertise in the Battlefield
Unlike semi-autonomous weapons systems, which leave target selection to humans and reserve computer-activated agency for implementing pre-selected aims, true Lethal Autonomous Weapon Systems (LAWS) enable AI-based systems to make targeting decisions. Human judgment often integrates ethical and legal decision-making, but there is no reason to assume AI-based systems can do the same.
Can LAWS be designed to simulate human ethical decision-making? This question may require reflection on what human beings are actually doing when they engage in ethical reasoning. Given that human ethical decision-making is frequently flawed, the question arises whether AI-based systems should be designed after human ethical decision-making or whether a different modality is preferable for meeting human goals. Are our goals better met through the human mode of reasoning, which is case-by-case, impressionistic, and based on intuition? Or might human goals be better served through the use of the top-down, systematic reasoning of machine decision-making, especially in view of the flawed and inconsistent nature of ethical decision-making? The session will examine these questions and how decision speed affects and alters the ability to exercise moral judgment.

Responsibility and Accountability through the Autonomous Weapons System Life Cycle
The use of AI technologies in weapons systems has triggered a debate, especially regarding human control, responsibility, and accountability in autonomous and intelligent systems. However, most ethical and legal discussions focus primarily on the point of use of hypothetical AWS.
Ethical and Legal responsibility and accountability for AWS span the entire life cycle, requiring human oversight from design to decommissioning. Ethical and legal obligations shift across phases, ensuring that military operators, commanders, and engineers remain responsible for and in control of the decisions machines make. This includes decisions made during design and development, assessments during testing and evaluation, and ultimately decisions during deployment and command.
The session will examine the use of LAWS and the need to create an effective legal system. This could include a strict liability system, so AI manufacturers must internalize the costs of the externalities associated with their weapons systems. It will also assess the burden of both institutional review and individual accountability that the law of armed conflict imposes on military organizations and the people who use AI-enabled systems. Additionally, the session will examine whether societies and their constituent organizations and citizens have a moral obligation to develop and use autonomous weapons if their adoption can better protect noncombatants from harm in war.
