In a post for West Point’s Articles of War blog, derived from their work “Establishing a Practical Test for the End of Non-International Armed Conflict” in the International Review of the Red Cross, Benjamin Farley, member of CERL’s Advisory Council, and Alka Pradhan offer a three-prong test for establishing when a non-international armed conflict (NIAC) ends under the law. Absent consensus on how to determine the end of armed conflicts, civilian populations may be subject to protracted violence that would be prohibited in non-war circumstances.
